Settlement information last updated on November 29, 2012:

  Distribution of awards via an account credit or award check is now complete.  Award checks were mailed between the dates of November 12, 2012 and November 26, 2012 in the form of a postcard check.  Those checks mailed toward the end of November may not be delivered until early December. Calculations were done for each individual Settlement Class Member using that class member’s own Account and Overdraft Fee history and applying the formula set forth in the Court-approved Settlement Agreement. Settlement information last updated on November 9, 2012:

  On November 7, 2011, the Court granted final approval to the Settlement with Bank of America, approved service awards to the Plaintiffs, and awarded attorneys’ fees to Class Counsel.   On November 22, 2011, the Court entered a corresponding order and judgment that formalized the Court’s final Settlement approval, as well as the service awards and the fee award.  Several appeals of the Judgment were timely filed, which had the effect of postponing the Effective Date of the Settlement and delaying distribution of the Settlement Fund. All appeals from the Judgment have now been finally resolved.  Consequently, implementation of the Settlement is again moving forward.  Account credits were issued on November 2, 2012 to those Settlement Class Members who, under the terms of the Settlement, are receiving their settlement distribution by account credit, and checks will be mailed between November 16 and 30, 2012, to those Settlement Class Members who, under the terms of the Settlement, are receiving their settlement distribution by check. ________________________________________________________________________________________________

  El 7 de noviembre de 2011, el Tribunal otorgó la aprobación definitiva del Acuerdo con Bank of America, aprobó los laudos de servicio a los Demandantes y adjudicó honorarios de abogados al Abogado del Grupo. El 22 de noviembre de 2011, el Tribunal dictó una sentencia correspondiente que formalizó la aprobación definitiva del Acuerdo por parte del Tribunal, así como los laudos de servicio y la adjudicación de honorarios. Se presentaron oportunamente varias apelaciones de la sentencia, que tuvieron el efecto de posponer la fecha de entrada en vigencia del Acuerdo y retrasar la distribución del Fondo del acuerdo.
 
 Todas las apelaciones de la Sentencia se resolvieron finalmente. En consecuencia, la implementación de la Sentencia sigue nuevamente adelante. Welcome to the website for the Settlement with Bank of America, N.A. in the litigation named In Re: Checking Account Overdraft Litigation, U.S. District Court for the Southern District of Florida, No. 1:09-MD-02036-JLK. This website provides information regarding a Settlement which has been reached in class action lawsuits about the order in which Bank of America, N.A. posted debit card transactions to customer accounts, and the effect the posting order had on the number of overdraft fees the bank charged its account holders. Current and former holders of Bank of America consumer checking and/or savings accounts may be eligible for a payment or account credit from the Settlement Fund. You are a member of the Settlement Class if you:

  • Had a Bank of America consumer checking and/or savings account that you could access with a Bank of America debit card, anytime between January 1, 2001 and May 24, 2011, and
  • Were charged one or more overdraft fees as a result of Bank of America’s practice of posting debit card transactions from highest to lowest dollar amount.

 If you are included in the Settlement Class and entitled to receive a cash benefit, you do not need to do anything to get a payment or account credit. If the Court approves the Settlement and it becomes final and effective, you will automatically receive a payment or account credit.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

GET A PAYMENT OR ACCOUNT CREDIT:

You do not have to do anything to get a payment or account credit from the Settlement. If the Court approves the Settlement and it becomes final and effective, all identifiable Settlement Class Members who are entitled to receive a cash benefit and who remain in the Settlement Class will automatically get a payment or account credit and will give up their legal rights against Bank of America about the claims in this litigation.

EXCLUDE YOURSELF FROM THE SETTLEMENT:

Get no benefit from the Settlement. This is the only option that allows you to retain your right to bring any other lawsuit against Bank of America about the claims in this litigation.

OBJECT:

Write to the Court if you don’t like the Settlement. For an objection to be valid, it must contain the information specified in paragraph 62 of the Settlement Agreement.

GO TO A HEARING:

Ask to speak in Court about the fairness of the Settlement.

DO NOTHING:

You will still receive any payment or account credit to which you are entitled, and will give up your legal rights.
